USPTO Filing Fees
The USPTO charges a trademark processing fee of $325 per class at the time of filing. The majority of trademark filings are filed under one class. Some filings require additional classes to incorporate the breadth of the mark being filed. As an example of a typical filing, a trademark for a brand of coffee could be filed under class 30, which is the class for staple foods, specifically:
Coffee, tea, cocoa, sugar, rice, tapioca, sago, artificial coffee; flour and preparations made from cereals, bread, pastry and confectionery, ices; honey, treacle; yeast, baking-powder; salt, mustard; vinegar, sauces (condiments); spices; ice.
In some cases it is determined based on the mark that the filing can be made through a less expensive but more restrictive USPTO filing system called Teas Plus ($275 per class).
In the event that you are not using your desired trademark or service mark in commerce at the time of filing, you will need to file a “Statement of Use” showing that the mark is being used in commerce within six months of the USPTO’s acceptance of the mark. When the mark begins to be used in commerce, Thomas P. Howard, LLC will conduct a Statement of Use filing on your behalf for a flat fee of $125. The PTO charges a filing fee of $100 for the acceptance of the Statement of Use filing.
If evidence of commercial use does not become available in that initial six month timeframe, up to five extensions on the filing of the Statement of Use, each of six months in length, can be obtained from the USPTO with proper grounds.
